Terms of Service

1. General provisions

These terms set out the rules for using the website at mimir.trade and the conditions under which services are provided by electronic means within the meaning of the Polish Act of 18 July 2002 on the provision of services by electronic means (ustawa o świadczeniu usług drogą elektroniczną).

The service provider and owner of the website is MIMIR Sp. z o.o., registered office at ul. Frezerów 3, 20-209 Lublin, Poland, entered in the register of entrepreneurs of the National Court Register (KRS) under number 0000700328, REGON 36855101900000, VAT ID PL9462674269.

Use of the website is free of charge and voluntary. Using the website means accepting these terms.

2. Definitions

• Website — the site available at mimir.trade, including all of its pages.
• Provider — MIMIR Sp. z o.o., the owner of the Website.
• User — any person using the Website.
• Contact form — the form provided on the Website for sending an enquiry to the Provider.
• Service provided by electronic means — a service performed without the simultaneous presence of the parties, through the transmission of data at the individual request of the User, sent and received by means of electronic data processing equipment.

3. Scope of services

The Provider offers two services on the Website:

1. Access to content — free access to information about the Provider’s business and the categories of goods it supplies.
2. Contact form — the option to send a commercial enquiry.

The content of the Website, including the descriptions of goods categories, is informational and does not constitute an offer within the meaning of Article 66 § 1 of the Polish Civil Code. No contract of sale or supply is concluded through the Website; sending an enquiry is an invitation to negotiate, and the terms of any cooperation are agreed individually.

The Provider conducts wholesale trade addressed to businesses. The Website is not intended to serve consumers within the meaning of Article 22¹ of the Polish Civil Code.

4. Technical requirements

To use the Website you need:

• a device with internet access,
• a web browser supporting HTML5 and CSS,
• a working e-mail address, if you use the Contact form.

JavaScript is not required: the Contact form also works with scripting disabled. Enabled JavaScript improves convenience, for example by pointing out incorrectly completed fields without reloading the page.

The Provider makes every effort to keep the Website continuously available, but reserves the right to technical breaks necessary for its maintenance.

5. No unlawful content

The User undertakes to use the Website in a manner consistent with the law and good practice, and in particular not to supply content of an unlawful nature.

The following are prohibited:

• sending, through the Contact form, content that infringes the rights of third parties, is offensive or misleading,
• using the Contact form to send unsolicited commercial information,
• any action that disrupts the operation of the Website, including attempts at unauthorised access and automated bulk submission of enquiries.

Where these rules are breached, the Provider may decline to consider the enquiry and may restrict access to the Website from the IP address concerned.

6. Intellectual property

The content of the Website — including texts, photographs, graphics, page layouts and the MIMIR word and figurative mark — is legally protected and is either owned by the Provider or used by it under the appropriate rights.

Copying, distributing or otherwise using this content in whole or in part, for purposes other than permitted personal use, requires the Provider’s prior written consent.

7. Complaints

Complaints about the operation of the Website may be submitted:

• by e-mail to [email protected],
• in writing to ul. Frezerów 3, 20-209 Lublin, Poland.

A complaint should describe the problem and include contact details that allow a reply to be sent.

The Provider considers the complaint and replies within 14 days of receiving it, to the address the complaint was sent from, unless the User indicates another means of contact.

8. Personal data

The rules for processing personal data submitted through the Contact form are described in the Privacy Policy, and the rights available to you in the GDPR information. Information about cookies is set out in the Cookie Policy.

Providing data is voluntary, but necessary in order to answer an enquiry.

9. Final provisions

The Provider reserves the right to amend these terms, in particular where the law or the scope of the services changes. Amended terms take effect on the day they are published on the Website; the date of the last update is given at the top of this document.

Matters not covered by these terms are governed by Polish law, in particular the Civil Code and the Act on the provision of services by electronic means.

Disputes arising from the use of the Website are settled by the court having jurisdiction over the Provider’s registered office.

These terms were drawn up in Polish. In the event of any discrepancy between the Polish version and its translation into another language, the Polish version prevails.
